This Privacy Statement describes in greater detail the privacy practices of EsiHome Technologies Inc. and its affiliates and subsidiaries, meaning companies related by common ownership or control (“us,” “we,” “our”) responsible for collecting and maintaining certain information about you.

If a Service you’re using links to this Privacy Statement, this Statement applies to you. This Privacy Statement (“Statement”) applies to our sites, products, and services (collectively, “Services”) that link to this Statement. EsiHome Technologies Inc. is the controller of all Personal Information subject to this Statement for our Services targeted to Canadian customers. We also provide Services in many other countries. If you are accessing a non-Canada version of our Services, the EsiKidz entity responsible for your Personal Information can be found here.

2. WHAT WE DO WITH YOUR INFORMATION

We want to be clear about what information we collect and how we use it to deliver our Services to you, improve your daily business operations, operate our business, and help make our Services useful, more intelligent, and better for you. We do not sell or share your Personal Information with third parties for their own commercial use without your consent.

While no transmission of information via the internet is completely secure, we take reasonable measures to protect your personal information. However, we cannot guarantee the security of your personal information transmitted to our website; any transmission is at your own risk. Once we receive your information, we use strict procedures and security features to help prevent unauthorized access.

In connection with accessing our Services, we may collect information from you that can be used to identify you (“Personal Information”), such as your name, business address, email address, phone number, username, and password.

We collect information when you register or open an account, sign in, pay a bill, purchase a Service, use a Service, call us for support, or provide feedback. We may also obtain information from other companies or third parties, such as when you sync a third-party account or service with your EsiKidz Service, or when we use service providers to supplement the Personal Information you provide (e.g., validating your mailing address). We also collect content or other information you provide or create when interacting with our Services.

We may also automatically collect usage information when you access our Services (“Usage Data”), such as Internet Protocol (“IP”) addresses, log files, unique device identifiers, pages viewed, browser type, links clicked, and other usage information collected from cookies and tracking technologies. For example, we collect IP addresses to monitor regions from which users access our Services. We also collect IP addresses as part of login and security features. When location-based Services are enabled, we may collect Global Positioning System (GPS) location data and/or motion data.

Our Services may change over time, and we may introduce new features that collect new or different types of information.

You may unsubscribe via email links, reply STOP for SMS, or disable push notifications at the device level.

We use cookies and similar technologies to improve Services and advertising. You may manage cookies through your browser settings.

Social media features may collect IP address and usage data. These features are governed by third-party privacy policies.

4. DATA USE, RETENTION, AND YOUR ACCESS RIGHTS

When you enter or upload your data into our services, we don’t own that data, but you grant us a license to use, copy, transmit, store, analyze, and back up all data you submit to us through our services, including personal data of yourself and others, to: enable you to use our services; allow us to improve, develop, and protect our services; create new services; communicate with you about your subscription; and send you information we think may be of interest to you based on your marketing preferences.

We respect your privacy and take data protection seriously. In addition to these terms, our privacy notice sets out in detail how we process your own personal data that you enter into Esikidz, such as your name and email address.

c) Use of personal data you enter about others

Depending on where your contacts are based, our data processing terms may also apply to the personal data of others (such as your customers, suppliers, and employees) that you enter Esikidz.

d) Anonymized statistical data

When you use our services, we may create anonymized statistical data from your data and usage of our services, including through aggregation. Once anonymized, we may use it for our own purposes, such as to provide and improve our services, develop new services or product offerings, identify business trends, and for other uses we communicate to you.

e) Data breach notifications

Where we believe there has been unauthorized access to personal data inside your subscription, we will notify you and provide information about what has happened. Depending on the nature of the unauthorized access and the location of your affected contacts, you may be required to assess whether the unauthorized access must be reported to the contact and/or a relevant authority. We believe you are best placed to make this decision because you will have the most knowledge about the personal data stored in your subscription.

f) Data retention

In accordance with and as permitted by applicable law and regulations, we will retain your information as long as necessary to serve you, to maintain your account for as long as your account is active, or as otherwise needed to operate our business. When you close your account, we may continue to communicate with you about our Services, provide important business updates that may affect you, and inform you about products and services that may interest you, unless you have opted out of receiving marketing communications.

We may also continue to use some of your information for business purposes, to improve our offerings, or in some cases to develop new ones. We will retain and use your information as required by applicable regulations and Esikidz’s records and information management policies to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete any outstanding transactions, and for the detection and prevention of fraud.

As required by applicable law, including PIPEDA, you may contact us to confirm whether we maintain or process on behalf of a third party any of your Personal Information, and to review it to verify its accuracy and the lawfulness of our processing of such Personal Information. Where you determine that the Personal Information, we collected about you is inaccurate or processed in violation of applicable law, including PIPEDA, you may also request that your Personal Information be corrected, amended, or deleted.

You or we may share each other’s confidential information with legal or regulatory authorities if required to do so.

While we have taken steps to protect your data, no method of electronic storage is completely secure, and we cannot guarantee absolute security. We will notify you if there appears to be unauthorized access to your account, and we may restrict access to certain parts of our services until you verify that access was by an authorized user.

We may introduce security features to make your account more secure, such as two-step authentication. Depending on where you are or what services you use, we may require you to adopt some of these features. Where security features are optional, you are responsible (meaning we are not liable) for any consequences of not using them. We strongly encourage you to use all optional security features.

c) Your responsibility to secure your data

You are responsible for keeping your login details secure, not allowing others to use them, and ensuring strong security on your systems. If you become aware of unauthorized use of your password or any breach of security related to your account or linked email, you must notify us immediately.

You also agree not to use free-form fields in any Esikidz systems or services to store personal data (unless the field explicitly requests it, such as first name or last name) or credit card details.

We do not knowingly collect information from minors. Esikidz.com provides a management platform for childcare facilities; the customer (service subscriber) owns the data on the platform. For support or maintenance purposes, we may access the data with the consent of the customer who owns it, and we comply with the Personal Information Protection and Electronic Documents Act.

EsiKidz Services are intended for and directed to adults. Our Services are not directed to minors, and we do not knowingly collect Personal Information from minors.
